These Terms of Service ("Terms") govern your access to and use of sistemahub.com, including its project information and contact form (the "Website"). The Website is operated by SistemaHub ("SistemaHub", "we", "us", or "our") in the Philippines.
By using the Website, you agree to these Terms. If you do not agree, do not use the Website. Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded under applicable Philippine law.
The Website presents information about SistemaHub, its products, selected client projects, and the types of systems and website work we offer. Website content is for general information and inquiry purposes. It is not a binding offer, quotation, service-level commitment, warranty, or promise of specific results.
Access to a SistemaHub software product may be governed by separate product terms presented during registration, purchase, or access. Custom work, paid services, subscriptions, support, data processing, and deliverables are governed by the applicable proposal, order form, statement of work, licence, data-processing agreement, or other written contract. If a specific written agreement conflicts with these Website Terms, that agreement controls for the subject it covers.
Submitting the contact form or exchanging preliminary messages does not create a client relationship, partnership, agency, fiduciary duty, exclusivity obligation, or contract. An engagement begins only when the relevant parties accept a written agreement or another legally valid offer and acceptance.
Do not send passwords, payment credentials, government identifiers, health information, trade secrets, or other highly sensitive or confidential information through the contact form. Although we handle personal data under our Privacy Notice, a website inquiry does not by itself create a non-disclosure agreement.

Their appearance in a project page does not transfer ownership or imply an endorsement beyond the relationship accurately described on that page.
We aim to keep Website information clear and current, but products, features, availability, prices, links, and project status can change. Confirm material requirements, current functionality, commercial terms, and availability directly with us before relying on them or making a purchasing decision.
Case studies describe the scope shown on the relevant page. Unless expressly stated in a signed agreement or supported by identified evidence, they do not promise the same outcome for another business and do not assert revenue, savings, ranking, bid wins, or other commercial results.
The Website links to product sites, client sites, demonstrations, and other third-party resources. We do not control third-party websites and are not responsible for their availability, security, content, or privacy practices. A link is provided for context and convenience and does not automatically constitute endorsement.

To the maximum extent permitted by law, SistemaHub will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising solely from access to or inability to access this Website, including loss of profit, opportunity, goodwill, or data.
Where liability arising solely from use of this Website cannot be excluded, our aggregate liability will not exceed PHP 10,000. This limit does not apply to fraud, wilful misconduct, gross negligence, breach of an obligation that cannot lawfully be limited, or liability governed by a separate written agreement. Some jurisdictions do not allow particular exclusions or limits, so parts of this section may not apply to you.
To the extent permitted by law, you agree to be responsible for losses, claims, and reasonable costs suffered by SistemaHub because of your unlawful use of the Website, material breach of these Terms, or infringement of another person’s rights. This does not require you to indemnify SistemaHub for its own fraud, wilful misconduct, or gross negligence.
These Terms are governed by the laws of the Republic of the Philippines, without prejudice to any mandatory consumer or data-protection rights that apply to you. Unresolved disputes are subject to the competent courts of the Philippines with proper jurisdiction.
We may update these Terms when the Website, our practices, or applicable law changes. We will post the revised Terms here and update the effective date. Changes apply prospectively from the stated effective date unless the law requires otherwise.
If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue. A failure to enforce a provision is not a waiver of the right to enforce it later.
